Construction Contract Documents

The policy of the Water and Environmental Program is that the Suggested Form of Agreement Between Owner and Contractor for Construction Contract (Stipulated Price) Funding Agency Edition and Standard General Conditions of the Construction Contract, Funding Agency Edition is the foundation for the construction contract documents used by our applicants.  Bulletin 1780-26 is available to provide guidance on the use of the EJCDC documents for projects financed by the Water and Waste Disposal Program.  It is strongly recommended that you review the Bulletin and contact the RD State Engineer before developing construction contract documents to ensure you are familiar with Rural Development construction contracting requirements.

The EJCDC, Funding Agency Edition documents are available here in PDF format for your inspection, but they must be purchased in electronic format from one of the EJCDC sponsor organizations - National Society of Professional Engineers, American Council of Engineering Companies, American Society of Civil Engineers, or the Associated General Contractors of America. 

Currently, the 2002 series EJCDC Funding Agency edition documents are approved for use along with supporting documents described in Bulletin 1780-26.  The 1997 EJCDC documents will not be accepted by RD.  Because some of the supporting documents listed in Bulletin 1780-26 are no longer available for sale in the 2002 edition, the following will be accepted in either the 2002 or 2007 form:

 * Note that C-615-A is the interim Payment Bond developed by EJCDC for use until a revised C-615 can be  developed that addresses industry needs in cooperation with the Surety and Fidelity Association of America.
