Engineering Agreements
Notice of Full Implementation of EJCDC Documents (6/6/05): Water and Environmental Programs (WEP) plans to limit the use of RD 1942-19, Agreement for Engineering Services, to projects for which procurement is expected to use Small Purchase Procedures (7 CFR 1780.72(a)) for construction contracts under $100,000. After December 31, 2005, the 2002 EJCDC, Funding Agency Edition will be the only form of Agreement for Engineering Services pre-approved for use on water and waste projects financed by the Water and Environmental Programs.
WEP is in the process of migrating to the E J C D C Standard Form of Agreement Between Owner and Engineer for Professional Services, Funding Agency Edition as the recommended agreement for engineering services. At present, a R D applicant and their engineer have the option of using the EJCDC document (contact State Engineer for state-specific attachments to be used with either set of documents) or the existing RD Form 1942-19, Agreement for Engineering Services. The EJCDC Funding Agency Edition document and its attachments are available here in PDF format for your inspection (page numbering may not be accurate). Copies of EJCDC documents must be purchased from one of the EJCDC sponsor organizations - National Society of Professional Engineers at 800-417-0348, available in either paper or electronic format, American Council of Engineering Companies at 202-347-7474, or American Society of Civil Engineers at 800-548-2723. RUS Bulletin 1780-26 is available that provides guidance on the use of the EJCDC documents on projects financed in part by Rural Development. It is strongly recommended that you review the bulletin before developing a set of documents using the EJCDC forms.
Phase in of 2002 EJCDC documents: WEP approved the use of E-510 on October 1, 2003. Engineering agreements for projects started after this date should be based on E-510 (2002) as described in RD Bulletin 1780-26. For those projects already in development, please continue to use the 1997 version of the Funding Agency Edition (FA) documents for WEP funded projects. WEP will continue to accept the 1997 version of the FA documents on those projects that were underway prior to the 2002 versions being available.
