Engineering Agreements

Below is a link to the Engineers Joint Contract Documents Committee (EJCDC) 2008 form “Agreement Between Owner and Engineer for Professional Services” (E-500).  This document is currently approved for use on all Water and Waste Disposal projects.  Please note that Rural Utilities Service (RUS) no longer allows and the EJCDC sponsoring organizations no longer sell a Funding Agency Edition of the EJCDC documents, however, Funding Agency edition forms may be used where their use was previously approved until a project is complete. 


RUS Bulletin 1780-26, “Guidance for the Use of Engineers Joint Contract Documents Committee (EJCDC) Documents on Water and Waste Disposal Projects with RUS Financial Assistance” describes RUS policy on the use of the 2008 version of the E-500 document and provides modifications that must  be made prior to use on a Water and Waste Disposal project funded by RUS.  There are several modifications, including the complete replacement of Exhibit C with a compensation packet from RUS Bulletin 1780-26, Attachment C, which addresses the consulting engineer’s compensation.

 
For projects using Small Purchase Procedures for selection of a construction contractor (7 CFR 1780.72(a)) instead of competitive bidding or negotiation (limited to projects with total construction costs under $100,000), RD form 1942-19, “Agreement for Engineering Services” may also be used.  This is a Federal form and may be downloaded for free. 


The EJCDC “Agreement Between Owner and Engineer for Professional Services” document and its attachments are listed below for inspection and training purposes only.  They are proprietary documents of the Engineers Joint Contract Documents Committee (EJCDC) and are held in copyright by the National Society of Professional Engineers (NSPE).  EJCDC documents may be purchased from one of the four EJCDC sponsoring organizations: the NSPE, the American Society of Civil Engineers (ASCE), the American Council of Engineering Companies (ACEC), and the Associated General Contractors of America (AGC)
